Three brothers whose videotaped confrontation with a Mississippi state trooper went viral over the summer were recently sentenced to 30 days in jail.
Eugene Lewis, Gary Lewis and Derrius Lewis pleaded guilty in Pike County Justice Court on Oct. 11, according to court records.
Eugene Lewis had been charged with careless driving, no seatbelt, driving with a suspended license, no auto insurance, disobeying a traffic control device, first offense DUI, disorderly conduct, disobeying a lawful order, resisting arrest and a window tint violation.
Gary “Packer” Lewis, 41, of Summit, was charged with driving without a license, no seatbelt, obstructing a public highway, obstructing arrest, resisting arrest, disobeying a lawful order, disorderly conduct, and window tint and license tag violations.
Derrius Lewis, 45, of Summit, was charged with resisting arrest, disorderly conduct, disobeying a lawful order, public drunk and disturbing the peace.
Judge Aubrey Rimes sentenced all three to 90 days, with 60 suspended.
Trooper Hayden Falvey arrested the brothers after stopping Eugene Lewis on Aug. 5 on Schmidt Road in McComb.
Falvey said he stopped Eugene Lewis for suspicion of speeding on Delaware Avenue, passing vehicles in the right lane and accelerating through a yellow light, all while not wearing a seatbelt.
Falvey said he smelled marijuana in the vehicle and detained Eugene Lewis for suspicion of driving under the influence.
Gary and Derrius Lewis pulled up in a different vehicle and started recording the encounter after Eugene Lewis alleged he was being mistreated.
Gary Lewis’ Facebook Live video of the encounter raised questions about the trooper’s handling of the situation, but Falvey was exonerated when Mississippi Department of Public Safety officials released video from the trooper’s patrol unit that investigators said showed Falvey acted appropriately.
