Osyka officials and the plaintiff against them still have no ruling on who owns a road in town.
Michael Drury and his attorney, Mary Blalock of Liberty, sued the town in February for ownership of Lula B. Woods Boulevard, claiming it was only created as access to the former Lula B. Woods School, the town had not maintained the road for years and that it is not traveled by the public.
Osyka, represented by Wayne Dowdy, countered that the road became public through general use, and that the town had maintained the road.
Circuit Judge Mike Taylor heard arguments in the case on May 9 in Magnolia, and has yet to issue a ruling.
“There’s been no change since we were in court,” Dowdy told board members Monday. “The judge will, on his schedule, issue a ruling. I think it will be in our favor.”
The board also:
• Postponed action on a request to place a trailer at 1008A 2nd St. The prospective owners did not atted the meeting and did not provide pictures of the trailer as requested.
• Approved paying invoices on the town’s sewer lagoon improvement project, including $96,330 to T.L. Wallace Construction, $2,557.60 to WGK Engineers and $4,580 to the Ferguson Group.
• Heard that someone broke into the Coca-Cola machine at Nyla’s. Mayor Allen Applewhite and police Chief Brian Mullins said the incident had not been reported.
• Was told that one of the town’s police cars is out of commission waiting for a part to be ordered and installed.
• Approved privilege licenses for Osyka Seafood and First Bank.
• Noted that the water loss for June was 48.52 percent. Town Clerk hilda Wall said there had been a large leak during the month, and also that the meter at the lagoon malfunctioned and did not register all the water going through the system there.
• Heard that court fines and fees totaled $4,439.50 in June.
• Noted 20 tickets written during the month, including two for possession of marijuana, three for driving without a license, two for lack of insurance, two for driving with a suspended license, and one charge each of possession of drug paraphernalia, possession of a controlled substance, driving with an open alcoholic container, running a stop sign, shoplifting, public drunkenness, disturbing the peace, hindering prosecution or apprehension of a suspect, resisting arrest, refusing to obey an officer and assaulting a police officer verbally.
