Former McComb Police Lt. Mark Anderson returned several pieces of city-issued property prior to a hearing that was scheduled for this morning in Pike County Justice Court, according to City Administrator Quordiniah Lockley.
The hearing did not take place because Anderson’s summons was issued less than three days before the hearing. State law requires three days notice.
The hearing may still take place at a later date, Lockley said.
The city filed a motion to have the property returned on May 5.
The property in Anderson’s possession included a Glock 21 handgun, Taser, Motorola radio, handcuffs, a bullet-proof vest and helmet, badge, Garmin GPS navigational device, clothing and other assorted items.
Anderson has a pending federal lawsuit against the City of McComb, in which he alleges charges of false arrest and imprisonment and malicious prosecution.
The suit dates back to a September 2009 incident when Anderson was arrested on charges of joyriding and impersonating an officer. Anderson had resigned a month before the incident but reported for work after former Mayor Zach Patterson announced Anderson’s intent to return at a city board meeting.
A judge remanded the charges two months later.
