A civil lawsuit filed over the 1995 death of Donald Lee Izzett Jr. has been settled out of court, while the criminal investigation into the case remains open.

Izzett’s estate filed a wrongful death lawsuit last year against Shane Guenther of Bremerton, Wash., accusing him of homicide. The case was filed in Pike County Circuit Court and moved to U.S. District Court.

Last month the parties reached a settlement, and on April 1 the case was dismissed, according to court documents.

Izzett disappeared in 1995, and in recent years authorities have conducted archaeological digs in Fernwood seeking his remains.  

“The criminal case until it’s solved will always remain open,” said District Attorney Dee Bates on Wednesday.
